As part of assisting an international client in recovering assets and enforcing a judgement of the High Court of Justice, the BM Dispute Resolution Team successfully attached bank accounts of a third party. The core issues were the enforceability of the English judgement in Switzerland and the requirements for blocking the assets of a third party holding assets as a straw man for the judgement debtor. The attachment covers both assets that actually belong to the judgment debtor (although held in the name of the third party) and the claims of the judgment debtor against the third party arising from the straw man relationship.
